1. Scope and acceptance

These Terms govern your access to and use of the Pekoe Tea Timer mobile application (“Pekoe”), this website, and support service (together, the “Service”). “We,” “us,” and “our” mean Izuba LLC, the App Store seller of Pekoe.

By downloading or using the Service, you agree to these Terms. If you do not agree, do not use Pekoe. Nothing here limits rights that cannot be waived under applicable consumer law.

2. App Store licence

Pekoe is licensed, not sold, for your personal, non-commercial use on Apple devices you own or control, subject to Apple’s usage rules and these Terms.

Apple’s Standard Licensed Application End User License Agreement also applies unless a custom licence is made available with the app.

3. Permitted and prohibited use

You may use Pekoe for lawful personal tea preparation, reference, and record keeping. Do not misuse the Service, interfere with its normal operation, attempt unauthorised access, distribute harmful code, or use the Service to violate another person’s rights.

You are responsible for the device, ingredients, equipment, recipes, and actions you choose while using Pekoe.

4. Your content, exports, and restore

You retain responsibility for the personal teas, notes, ratings, recipe settings, verdicts, and other content you enter. Pekoe stores that content on your devices and, when enabled, in the private iCloud database of your Apple Account. Pekoe does not claim ownership of it.

You control exported files and the destinations to which you send them. Restore replaces the current local journal, personal teas, and saved recipe settings only after you choose a JSON file and confirm. Keep an additional backup if you may need the current state later.

If iCloud is enabled for Pekoe, your journal, personal teas, and saved recipe settings sync to your other devices signed into the same Apple Account. This sync is provided by Apple under Apple’s terms; Pekoe operates no server of its own. Restoring from JSON replaces the current Pekoe data, and that replacement syncs like any other change.

5. Tea information and wellbeing notice

Brewing parameters, origins, process notes, harvest calendars, and Next Brew suggestions are provided for enjoyment and education. Tea varies with leaf, water, vessel, storage, and taste; results are not guaranteed.

Pekoe is not medical, dietary, allergy, food-safety, or professional advice. Consider your health, caffeine sensitivity, allergies, and safe handling of hot water. Seek qualified advice when needed.

Next Brew proposes one explained, optional adjustment. It never silently changes a recipe; you decide whether to save or disregard the suggestion.

6. Intellectual property and third-party material

Pekoe’s software, original interface, writing, brand, and arrangement of content are protected by applicable intellectual-property law. These Terms do not transfer ownership of Pekoe or its brand.

Reference artworks, maps, and other third-party material remain subject to their own rights and attributions. Map data includes OpenStreetMap contributors and is used under the applicable ODbL terms.

7. Apple and external services

The Service can invoke Apple features such as App Store, Siri, Shortcuts, notifications, Live Activities, Dynamic Island, MapKit, iCloud and CloudKit, the document picker, and the share sheet. Apple provides those services under its own terms and policies.

Apple, the Apple logo, iPhone, iPad, iCloud, Siri and Spotlight are trademarks of Apple Inc., registered in the U.S. and other countries and regions. App Store is a service mark of Apple Inc.

8. Price and updates

Pekoe is currently offered free of charge and contains no subscription or in-app purchase. The price and availability shown on the App Store product page presented to you govern your download.

We may improve, change, discontinue, or update features to maintain quality, security, compatibility, or product direction. Some updates may require a newer iOS or iPadOS version.

9. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.” We do not warrant uninterrupted, error-free, universally available, or purpose-specific operation.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded. Subject to that rule, Izuba LLC is not liable for indirect or consequential loss arising from reliance on tea information, loss of device or iCloud data, or third-party services beyond our reasonable control.

10. Governing law, changes, and contact

Mandatory consumer-protection rules continue to apply. Where a choice of law is permitted, the law of the jurisdiction in which the App Store seller is established applies without removing protections that cannot be waived in your usual place of residence.
